What is NDAA Compliance?

The National Defense Authorization Act (NDAA) is a federal law passed annually by Congress that sets defense policy priorities and funding levels. For law enforcement procurement, the key provision is Section 889 of the FY2019 NDAA (Public Law 115-232), which has remained in effect, and grown stricter, with each subsequent year’s authorization.

Section 889 contains two core prohibitions:

Section 889(a)(1)(A) – Prohibits federal agencies from directly procuring equipment, systems, or services that use covered telecommunications or video surveillance components manufactured by banned companies.

Section 889(a)(1)(B) – Prohibits any federal agency from entering into a contract with any entity — including private companies and local governments — that uses banned equipment in systems tied to federal work. This is the provision most relevant to law enforcement agencies receiving federal grants.
